On Wednesday, February 27, 2019, it will be 26 years since the crime in \u0160trpci, when members of the Republika Srpska Army (VRS), gathered at the railway station in \u0160trpci (Bosnia and Herzegovina), abducted 20 passengers from a train operating on the Belgrade-Bar route, and then killed them. They were all non-Serb civilians.<\/strong><\/p>\n

The Humanitarian Law Center (HLC)<\/a>, Women in Black, the Sand\u017eak Committee for the Protection of Human Rights and Freedoms, and the Youth Initiative for Human Rights in Serbia, would like to remind the public that the families of these victims have been waiting 26 years for justice from the courts in Serbia, and for recognition of their status as families of civilian victims of war.<\/strong><\/p>\n

The victims of this crime were: Esad Kapetanovi\u0107, Ilijaz Li\u010din, Fehim Bakija, \u0160e\u0107o Softi\u0107, Rifat Husovi\u0107, Halil Zup\u010devi\u0107, Senad \u0110e\u010devi\u0107, Jusuf Rastoder, Ismet Baba\u010di\u0107, Tomo Buzov, Adem Alomerovi\u0107, Muhedin Hani\u0107, Safet Preljevi\u0107, D\u017eafer Topuzovi\u0107, Rasim \u0106ori\u0107, Fikret Memovi\u0107, Fevzija Zekovi\u0107, Nijazim Kajevi\u0107, Zvjezdan Zuli\u010di\u0107 and one unidentified person.<\/span><\/p>\n

To date, the mortal remains of only four victims have been found. The body of Halil Zup\u010devi\u0107 was discovered in late 2009 on the banks of Lake Peru\u0107ac, while the mortal remains of Rasim \u0106ori\u0107, Jusuf Rastoder and Ilijaz Li\u010dina were discovered at the same location in 2010. The other victims are still unaccounted for.<\/span><\/p>\n

So far, only Neboj\u0161a Ranisavljevi\u0107 and Mi\u0107o Jovi\u010di\u0107 have been finally convicted for this crime. In the court proceedings against Neboj\u0161a Ranisavljevi\u0107 conducted before the High Court in Bijelo Polje (Montenegro), he was sentenced to 15 years in prison. Mi\u0107o Jovi\u010di\u0107, against whom proceedings were conducted before the Court of Bosnia and Herzegovina, admitted to the crime and was sentenced to five years\u2019 imprisonment.<\/span><\/p>\n

For this crime in \u0160trpci, the trial of ten of the accused is ongoing before the Court of Bosnia and Herzegovina. Among those accused are Luka Dragi\u010devi\u0107, Commander of the Vi\u0161egrad Brigade, and Boban In\u0111i\u0107, Commander of the Intervention Unit of the Vi\u0161egrad Brigade.<\/span><\/p>\n

In October 2018, <\/span>after three and a half years<\/span><\/a>, the Belgrade Court of Appeal finally confirmed the indictment against five members of the Vi\u0161egrad Brigade of the VRS for the crime committed in \u0160trpci. Although the start of the main trial was scheduled for January 2019, it was postponed owing to the illness of one of the accused.<\/span><\/p>\n

The families of the victims, most of whom are Serbian citizens, have been ignored by the state authorities responsible for the care of civilian victims of war (the Ministry of Labour, Employment, Veteran and Social Affairs, hereinafter, Ministry of Labour) \u2013 increasingly so over the two decades. Relatives of the victims of this crime, owing to the discriminatory legal framework in Serbia, are deprived of the right to obtain the status of family members of civilian victims of war, simply because their family members were killed outside the territory of Serbia, although they were Serbian citizens. With this status, the relatives of the victims would be provided with symbolic personal benefits in the form of monthly cash allowances and social support.<\/span><\/p>\n

The victims and their associations, as well as the <\/span>HLC<\/span><\/a> and other civil society organizations, have for many years been pointing out the inadequacy of the existing legal provisions, and their discriminatory implementation. Despite the serious objections of domestic and international actors, this law has not yet been altered. Instead, in August 2018 the Ministry of Labour brought the Draft Law on War Veteran and Disability Rights, which <\/span>retains the discriminatory provisions<\/span><\/a>.<\/span><\/p>\n

The HLC, Women in Black, the Sand\u017eak Committee for the Protection of Human Rights and Freedoms, and the Youth Initiative for Human Rights in Serbia urge the institutions of Serbia to effectively conduct criminal proceedings for this crime, and the Ministry of Labour and other competent institutions to pass a new law based on a <\/span>Model of the Law<\/span><\/a> on the Rights of Civilian Victims of Human Rights Violations Committed during and in connection with the Armed Conflicts in the period 1991-2001, which contains normative solutions for the realisation of victims\u2019 rights in accordance with international human rights treaties and other international standards in providing reparations to victims.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"The HLC, Women in Black, the Sand\u017eak Committee for the Protection of Human Rights and Freedoms, and the Youth Initiative for Human Rights in Serbia invites citizens, representatives of state institutions, media outlets and NGOs to join in an event marking the 26th anniversary of the crime in \u0160trpci, to take place on Wednesday, February 27, 2019 at 15:48, in front of the entrance to the former Main Railway Station in Belgrade. \r\n","protected":false},"author":2,"featured_media":7228,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"ngg_post_thumbnail":0},"categories":[57],"tags":[948,947,946],"acf":[],"yoast_head":"\nCrime in \u0160trpci -
